Perused the record and proceedings. The objection notified by the office is that, sole respondent Bhagabai @ Bhimbai Nagorao Motade is returned unserved on the ground that, she has reported to be dead. The bailiff report filed on record clearly indicates that, the said sole respondent died on 14/12/2009. The copy of death certificate issued by the Block Development Officer supports the contention that, sole respondent was expired on 14/12/2009. Thereafter, no steps have been taken by the appellant to bring on record the legal heirs of deceased sole respondent till this date. None is present on behalf of the appellant. Thus, it appears that, the appellant is not really interested in taking steps and to brig on rcord deceased sole respondent's legal heirs, if any. Hence, order.

ORDER

The appeal against sole respondent Bhagabai @ Bhimabai Nagorao Motade stands abated and dismissed. REGISTRAR (JUDL) SDM* 1579.2016 FA (Sr.No.71)
