The applicants seek to condone the delay of 916 days caused in filing the first appeal.

The learned advocate for the applicants submits that the applicants have lost their land and inadequate compensation has been granted to them. Due to financial difficulties and other circumstances as specified in Paragraph No.2 of the application, the delay is caused, which is not intentional.

Learned advocate appearing for respondent no.2 vehemently opposed the application to condone the delay. 1/2

Considering the result stated in the application, the delay of 916 days is condoned. However, the applicant shall not be entitled to claim the interest for the period of delay in case of grant of enhanced compensation in the appeal.

The civil application is allowed and the same is disposed of accordingly.
