VERSUS

RANDHIR RAGHUNATH LANDGE ...

AGP for Petitioners : Mr. P.P. More Advocate for Respondent no. : Mr. Deshmukh Avinash S. ...

CORAM : S.S. SHINDE & P.R. BORA, JJ.

Dated: March 30, 2015 ...

PER COURT :- This Writ Petition takes exception to the order dated 16.06.2014 passed by the Maharashtra Administrative Tribunal, Bench at Aurangabad in Original Application No. 777/2013. 2.

The learned counsel appearing for the respondent has tendered across the bar the Government Resolution dated 13th March, 2015 issued by the Higher and Technical Education Department, Government of Maharashtra and relying upon the contents of the said Government Resolution, the learned counsel appearing for the respondent submits that, the petitioner's services are regularized. His name appears at Sr. No. 26 of the List available with the said Government Resolution. He further submits that, the respondent will appear before the Maharashtra Administrative Tribunal in view of the fact that, the Supreme Court has rejected the S.L.P. challenging the judgment and order in case of "Sachin

10465.14WP Ambadas Dawale and others V/s The State of Maharashtra and another" in Writ Petition No. 2046 of 2010 decided on 19.10.2013 by the Bombay High Court, bench at Nagpur, on which the reliance is placed by the petitioner, for disposal of the Original Application on the basis of the pronouncement of Nagpur Bench and subsequent Government Resolution issued on 13th March, 2015 by the Higher and Technical Education Department, Government of Maharashtra. 3.

In that view of the matter, the Petition itself is against the interim order. In our opinion, no cause survives for consideration in this Petition. Hence Petition stands disposed of. ( P.R. BORA, J. ) ( S.S. SHINDE, J. ) ...
