PER COURT:- Perused the order passed by the Maharashtra Administrative Tribunal on 14.8.2009. The request made by the petitioner for appointment against the quota for Project Affected Persons (PAP) has been turned down by making reference to the judgment of the Full Bench in Writ petition No. 7472 of 2007. The Full Bench has held that the Project Affected Persons cannot be appointed without advertising the post ignoring their qualification and merit. It would be open for the petitioner to compete as and when the concerned Department issues an advertisement and his claim can be considered on the basis of merit and qualification from amongst the category of Project Affected Persons.

We do not find any error or inconsistency in the decision rendered by the MAT. The petition, being devoid of substance, stands rejected.
