Heard learned counsel Mr. Dahihande for the applicant. Learned A. G. P. Mr. Shinde appears for the respondent Nos. 1 and 3. None appears for the respondent No. 2, though served. 2.

Applicant who is claimant is praying for condonation of delay of 766 days caused in preferring first appeal against the judgment and award dated 04.05.2022 passed in L. A. R. No. 200 of 2014 by the 03rd Joint Civil Judge Senior Division, Dhule. Learned counsel for the applicant relies on the contents of para No. 2 of the application and submits that those are good grounds for condonation of delay.

The contents of the application have not been controverted by the respondents. There are no malafides on the part of the applicant in preferring appeal belatedly. It is desirable to consider the matter on merits. For the reasons stated in the application, the delay deserves to be condoned. 4.
