Learned Advocate for the petitioner submits that the petitioner has sought the copy of the measurement report and the map. The same is not provided though, the measurement has taken place in August, 2021.

According to the petitioner in a Civil Suit, the 6th Joint Civil Judge, Senior Division, Aurangabad, had appointed the respondent No. 2 as a Court Commissioner to measure and demarcate the suit land, as per the order passed therein. 3.

In case the measurement had been conducted, the report will have to be fled in the pending Civil Suit, in which the order was passed appointing the Court Commissioner.

29WP13037 The petitioner can make an application to the Court where the Civil Suit is pending and in which the order is passed to appoint the Court Commissioner. Naturally, the Court would pass appropriate order.

Writ Petition is disposed of. No costs.
