Learned counsel for the applicant and respondent submit that the parties have arrived at settlement and terms of settlement have been reduced into writing referring the same to be '' terms and conditions of the compromise '' and further that the same have been signed by parties and respective advocates today i.e. 11-4-2017. 2.

Learned counsel further submit that the terms and conditions of the compromise were read over to the parties and implications of the same as well were explained to

them. Parties understood the terms and conditions of the compromise and have accepted the same.

Learned counsel for parties further refer to that the terms and conditions of the compromise were verified before the competent officer of the high court in their presence and they have identified the respective parties before the competent officer.

According to learned counsel, the terms and conditions of the compromise are not unlawful nor are forbidden by law nor are opposed to public policy. 5.

It is further being requested that the terms and conditions of the compromise be sent to the court of Civil Judge, Senior Division, Kalyan, District Thane where the proceedings are pending.

Office to accordingly send the terms and conditions of the compromise to the concerned court at Kalyan, District Thane, keeping a photocopy of the same on record of this miscellaneous civil application which is to be marked as 'X' for the purpose of identification.

Having regard to aforesaid, it would be in fitness of things that in the proceedings pending before the concerned court at Kalyan, proper amendments pursuant to the terms and conditions of the compromise may be sought and thereupon the matter be proceeded with by the concerned court as early as possible.

As such, nothing further remains to be done in present miscellaneous civil application. The same stands accordingly disposed of.
