PER COURT :- In view of availability of alternate remedy of presenting an appeal under section 47 of the Maharashtra Regional Town Planning Act, the instant petition need not be entertained. Keeping open the option of the petitioner to avail of the remedy available in law, the writ petition stands disposed of.

If the petitioner presents an appeal as provided under law, within a period of 30 days from today, the appellate authority shall, in observance of the procedure prescribed under law, take appropriate decision, on merits, as expeditiously as possible and preferably within a period of six weeks from receipt of the appeal.
