DATE: 6th March, 2019 PER COURT:- Heard Shri A.B.Kale, learned Counsel appearing for the applicants and Shri S.S.Dande, learned Counsel appearing for the Acquiring Body.

It is pointed out that in the connected matters this Court (Coram: Shri S.V.Gangapurwala, J.) in Civil Application No.6389 of 2015 and connected matters permitted withdrawal of 25% of deposited amount on submitting an undertaking and 75% of deposited amount on furnishing solvent surety/security in the like amount. The learned Counsel for the applicants has prayed for passing similar order in the present matter also. The learned Counsel appearing for the Acquiring Body has consented for passing such order.

In view of above, the following order is passed.

{2} CA 1548 OF 2019

ORDER

I) The applicants are permitted to withdraw 25% of deposited amount on submitting undertaking to this Court that in the event the applicants are directed to deposit the said amount, the applicants would deposit the same within one month.

II) The applicants are further permitted to withdraw 75% of deposited amount on furnishing solvent surety/security/bank guarantee of any Nationalized or scheduled Bank in the like amount. III) The application stands disposed of.
