We have heard Mr. Salunke, learned counsel for petitioner and Mr. Dighe, learned counsel for respondent No.3. The learned counsel for petitioner submits that there are 15 Primary Agricultural Societies, who are the voters for the post of 11 Directors of respondent No.4. Out of 15 Primary Agricultural Societies, the term of 12 Agricultural Societies is over. So, only 3 Agricultural Societies would be entitled to participate in the election for the post of 11 Directors of the APMC. The same may not be appropriate.

Mr. Dighe, learned counsel for respondent No.3 submits that the decision has been taken for conducting the elections of

Primary Agricultural Societies in phase wise manner and the said process would commence. As far as the elections for the Directors of respondent No.4 APMC is concerned, the voters list is not yet finalized. According to the learned counsel, the election was sought to be conducted of APMC as there was an order of this Court passed in Writ Petition No.6102 of 2018 and connected matters. We have considered the said issue in Writ Petition No.11669 of 2021 with connected writ petitions under order dated 18th November, 2021.

The APMC has total 18 Directors. Out of 18 Directors, 11 Directors are the representatives of the Primary Agricultural Societies. In the instant case, there are 15 Primary Agricultural Societies and out of 15, the term of the Managing Committee of 12 Primary Agricultural Societies is over. These 12 Societies would not be in a position to participate in the elections. Almost 75% of the Societies would not be in a position to participate in the elections. We have considered the same in Writ Petition No.11669 of 2021 with connected writ petitions under order dated 18th November, 2021.

In view of that, the present writ petition is disposed of in terms of the order dated 18th November, 2021 passed in Writ Petition No.11669 of 2021 with connected writ petitions. No costs. [ R. N. LADDHA, J. ] [ S. V. GANGAPURWALA, J. ] nga
