Civil Application has been moved by original plaintiff for withdrawal of the amount deposited in this Court pursuant to order dtd. 02.08.2016. The suit had been instituted claiming maintenance against defendants. The suit was decreed. The plaintiff had filed the appeal for enhancement, which appears to have been allowed to some extent. As such, the original defendants are before this Court in Second Appeal.

While passing the order on 02.08.2016, this Court had directed the defendants to deposit sum of Rs. 1,00,000/-. Having regard to the nature of dispute, I deem it appropriate to allow the applicant/original plaintiff to withdraw the said sum.

Accordingly, civil application is granted in terms of prayer clause 'B' and is disposed of.
