Applicants are seeking substitution of the appellants as well as respondent No. 1 in the second appeal by condoning the delay.

Appellant died on 22.09.2020 and the respondent No. 1 died on 31.07.2021. They are survived by by the legal heirs shown in the title cause of the application. The cause of action

2 16 ca 14132.23 survives against them. They are necessary parties. There are no malafides on their part in preferring application belatedly. 4.

For the reasons stated in the application, the civil application is allowed in terms of prayer clauses 'B' "C" and "D". Both the parties shall be at liberty to carry out the amendment. The civil application is disposed of.
