This is an application for condonation of delay of 363 days caused in filing the present First Appeal.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate for the respondent strongly opposed the application and submitted that sufficient reasons to condone the delay are not stated in the application.

Considering the reasons stated in the application, it appears that some time was spent in obtaining advice from their Advocate at Parbhani. Therefore, the applicants could not file the appeal within prescribed time and the delay does not appear to be deliberate. Hence, following order:

Civil Application is allowed.

Delay of 363 days caused in filing the First Appeal is hereby condoned.
