Learned advocate for the petitioner makes a grievance that though the petitioner is denied pension, he is entitled for contributory pension, for which contribution was obtained from him and therefore, respondent No. 1-District Social Welfare Officer and respondent No. 3-Head Master were duty bound to give contribution of their part and pension should have been given to the petitioner. So far as salary is concerned, District Social Welfare Officer has held that Management i.e. respondent No. 2 and 3 are liable to pay salary of the petitioner. Management therefore ought to have paid arrears of salary. Bhagyawant Punde

Learned advocate for the Management submits that Management has already paid salary of the petitioner. In support of said statement, learned advocate for respondent No. 2 and 3 has placed on record RTGS receipt of Osmanabad Janta Sahakari Bank Ltd., Osmanabad, showing that amount of Rs. 4,62,159/- is deposited in the account of the petitioner towards arrears of salary. A letter dated 31.05.2023 addressed to respondent No. 2 by petitioner is also placed on record, wherein petitioner has acknowledged that he has received salary as per 6th pay Commission and he has no objection about the same. Said documents are marked 'X' collectively for identification. 3.

In view of above compliance, Contempt Petition is disposed of.

Petitioner may avail appropriate remedy if he is aggrieved by non payment of pension and part of arrears of salary, which according to him is not paid to him. (MANJUSHA DESHPANDE, J.) (NITIN B. SURYAWANSHI, J.) Bhagyawant Punde
