This application is filed with a prayer that during pendency of criminal revision application, the substantive part of sentence awarded by the learned Judicial Magistrate, First Class, Ambajogai in R.C.C. No.40 of 2005 on 10.07.2013 and the same is confirmed by the learned Additional Sessions Judge, Ambajogai, district Beed in Criminal appeal No.36 of 2013, vide judgment and order dated 3.10.2022, may be suspended/stayed and the applicant be released on bail.

Learned advocate for the applicant submits that during pendency of the trial as well as the appeal, the applicant was on bail and he has not misused the liberty granted by the lower courts. The

cran3633.22 -2applicant has deposited the fine amount.

I have also heard the learned A.P.P. for the State and he has not disputed the above submission made by learned advocate for the applicant.

In view of above, the criminal application is allowed. 6.

During pendency of criminal revision application No. 318 of 2022, the substantive part of sentence awarded by the learned Judicial Magistrate, First Class, Ambajogai in R.C.C. No.40 of 2005 on 10.07.2013 and confirmed by the learned Additional Sessions Judge, Ambajogai, district Beed in Criminal appeal No.36 of 2013, vide judgment and order dated 03.10.2022 stands suspended and the applicant be released on bail on the same terms and conditions, as were before the trial court.
