The applicant seeks to condone the delay in setting aside abatement and bringing legal heirs of sole respondent Vasant Baburao Purohit. The cause of action survives against legal heirs of deceased respondent Vasant. The information of his death was furnished by the learned counsel and accordingly steps are taken.
