Learned Advocate Mr. L. C. Patil, representing the applicants submits that during the pendency of the First Appeal, the claimant namely Sunita Laxman Sawant is died, who is now represented by her legal representatives i.e. applicant nos.3A to 3D in the Civil Application. 3.

In view of this, Mr. L. C. Patil, learned Advocate submits that the appellants need to be directed to amend the title clause of the appeal by adding the names of the applicant

ca-10474-2025 nos.3A to 3D as legal representatives of the deceased claimant. Mr. Patil would further submit that there is delay of 1201 days in filing this application which is not out of any lethargy or negligence on the part of the applicants. Due to unawareness of the legal proceedings, they could not approach the Advocate earlier.

Mr. S. V. Hange, learned AGP and Mr. Umesh Mitkari h/f Mr. M. S. Kulkarni appearing for the Acquiring Body places their no objection for passing appropriate orders. 5.

In view of this, I pass following order:

ORDER

a.

Civil Application is allowed.

b.

The delay of 1201 days caused in filing the present Civil Application stands condoned.

c.

Appellants shall amend the title clause of appeal and applications therein by incorporating the names of applicant nos.3A to 3D as legal representatives of deceased claimant Sunita Laxman Sawant within four weeks from today.

d.

Civil Application stands disposed of.
