IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO. 2868 OF 2018 IN RC NO.1301 OF 2017 DAMODAR BAJABA RAUT

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE COLLECTOR, BEED AND ANOTHER ...

Advocate for Applicant : Smt. A. V. Gangakhedkar AGP for Respondents: Shri S.K.Tambe ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 29th JUNE, 2018.

...

PER COURT :

1.

The applicant prays for condonation of almost 19 years (6754 days) delay in filing the Civil Revision Application. 2.

I have considered the submissions of the learned advocate for the applicant and have gone through the application paper book with her assistance.

3.

The order sought to be challenged is dated 06/08/1996 by which, the LAR Court has rejected the reference case filed under Section 18 seeking enhancement in compensation. The enhancement sought is @ Rs. 1,000/- per sq. mtr. and for the trees. The entire blame is sought to be put on the advocate

16-ca-2868-18.odt representing the applicant and it is contended that the advocate was not diligent.

4.

I do not find that these reasons can be said to be sufficient to justify the condonation of delay of 6754 days. Consequently, this Civil Application being devoid of merit is, therefore, rejected.
