IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 913 WRIT PETITION NO. 2106 OF 2018 POPAT KISANRAO MULE

VERSUS

NANDABAI LAXMAN JAYBHAYE ...

Mrs. M.A.Kulkarni, Advocate for Petitioner.

...

CORAM : V.L.ACHLIYA, J.

DATE : 10th APRIL, 2018 ...

ORAL ORDER :

1.

By the present petition, the petitioner has challenged the order dated 10/08/2015 passed by District Judge - 3, Beed in Misc. Civil Appeal No. 93/2014. 2.

In nut-shell, it is the contention of the learned counsel for the petitioner that the trial Court has rejected the application filed by the plaintiff - respondent seeking temporary injunction vide order dated 12/09/2014. The appellate Court has allowed the Appeal and thereby restrained the defendants to obstruct the possession of the plaintiff in respect of suit land.

3.

In view of the fact that the impugned order was passed on 10/08/2015, I am not inclined to entertain the

2 W.P. 2106.2018 petition.

4.

Writ Petition stands disposed of. Trial Court is directed to expedite the hearing of the case and decide the Suit as early as possible and preferably within one year. [V.L.ACHLIYA, J.] KNP/W.P. 2106.2018
