The trial Court has turned down the petitioner's application for sending the cheque in question to the handwriting expert for examination of the alleged signature appearing thereon only on the ground that evidence of the complainant was underway and such prayer may be considered when the petitioner's turn to lead the defence evidence would come. 2.

In this view of the matter, criminal writ petition stands disposed of. The petitioner may move similar application before the trial Court when his turn to lead defence evidence would be there and the trial Court would consider the same on it's own merits.
