The Petitioner is aggrieved by the direction issued by Respondent No.2/ Chief Executive Officer, Zilla Parishad, Hingoli dated 30.09.2013. An appeal under Rule 14 of the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules, 1966 has been filed by the Petitioner before the Additional Divisional Commissioner, Aurangabad Division, Aurangabad.

The grievance is that the said appeal is still not registered and there is no hearing.

*2* 901.wp.9281.13 Considering the above, this Writ Petition is disposed of with a direction to the Additional Divisional Commissioner, Aurangabad Division, Aurangabad to register the said appeal filed by the Petitioner and decide the same as expeditiously as possible.

The litigating sides, therefore, shall appear before the Additional Divisional Commissioner, Aurangabad Division, Aurangabad on 24.02.2017. Formal notices need not be issued. The litigating sides shall, thereafter, participate in the hearing of the appeal on such dates as may be posted by the Additional Divisional Commissioner. Until the appeal is decided, Respondent No.2/ Zilla Parishad shall not fill in the post which has fallen vacant on account of the removal of the Petitioner and which has been kept vacant considering the earlier orders of this Court directing to maintain status-quo. The learned AGP appearing on behalf of the State would convey this order to the Additional Divisional Commissioner, Aurangabad Division, Aurangabad.
