1] We have heard Mr.Kazi learned counsel for the petitioner and Mr.Quadri Syed Md.Saquaebuddin H. learned counsel holding for Mr.G.L.Deshpande, learned counsel for respondent no.1.

2] It is submitted that appeal is filed by the respondent no.1 before the Sub Divisional Officer. The Sub Divisional Officer has granted stay in the matter. 3] In case there are no prohibitory orders and no other impediment in deciding the appeal filed by the respondent no.1 wherein stay has been given to the mutation entry in favour of the petitioner, then, respondent

13398.21WP no.7 shall decide the said appeal on its own merits, in accordance with law, after hearing all parties concerned, preferably within six [06] months.
