Mr. Nagode, the learned counsel submits that, on 03.10.2012 the petitioner has given representation to the respondent No. 1 for appointment being project affected person. The said representation is not considered.

Mr. Palnitkar, the learned A. G. P. submits that, in view of the judgment of the Full Bench of this Court, the petitioner has to compete.

As the representation is pending with the respondent No. 1, we are not dilating on the merits of the matter.

We dispose of the writ petition by directing the respondent No. 1 to decide the application/representation of the petitioner (Exhibit - J) on its own merits as per the policy and law expeditiously and preferably within a period of six (6) months from today. No costs.
