The applicant was convicted by Judicial Magistrate First Class, Purna, by judgment and order dated 25th October, 2010, passed in S.C.C. No.35 of 2005, for offences punishable under sections 304-A, 279 and 427 of the Indian Penal Code and sentenced to suffer R.I. for six months and to pay fine of Rs.2000/-, in default to suffer further R.I. for one month; R.I. for one month and to pay fine of Rs.500/-, in default to suffer further R.I. for fifteen days and to pay fine of Rs.1,500/-, in default to suffer S.I. for one month, respectively, which order came to be confirmed by Sessions Judge, Parbhani, vide judgment and order dated 14th October, 2015, passed in Criminal Appeal No.67 of 2010.

It is not in dispute that the applicant was on bail during the trial and the appeal. In view thereof, Criminal Application stands allowed in terms of prayer clause (B), on the same terms and conditions as before appellate court.
