2025:BHC-AUG:33597-DB
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 14429 OF 2025 Meena Sunil Pawar
VERSUS
The State Of Maharashtra Through Its Secretary And Others Mr. R. R. Awhad, Advocate for petitioner Mr. A. M Phule, AGP for respondent-State
CORAM
: Smt. Vibha Kankanwadi & Hiten S. Venegavkar, JJ.
DATE : 03rd December, 2025 PER COURT :- 1.
Present petition has been filed for directing the respondents to consider and decide the petitioner's application dated 25.08.2023 as well as the subsequent application dated 28.02.2025 submitted to the Gramsevak/Sarpanch for appointment to the post of Asha Worker at village Jomegaon, Tq. Loha, Dist. Nanded.
2.
Heard learned Advocate for the petitioner. He has taken us through the documents and submits that though the petitioner had given application within time, it has been pretended that there was application only of one lady which was then considered and one Smt. Gavhane came to be appointed. Learned Advocate for the petitioner further contends that as per the instructions of the petitioner Smt. Gavhane is only 10th passed whereas the petitioner is 12th passed and intentionally the
application of the petitioner was not considered. 3.
We have gone through the documents and it can be seen that at some places the petitioner has signed as 'Meena' stating that after her marriage her name is 'Meena Sunil Pawar'. The certificates issued by Secondary and Higher Secondary education, Pune shows her name 'Hanmante Meeratai Narayan'. It is stated that she has given affidavit which is now at Page 45 stating that prior to her marriage her maiden name was 'Meeratai Narayan Hanmante' and then she was married to Mr. Sunil Pawar thereafter her name is 'Meeratai Sunil Pawar'. She says that on her Adharcard, her name is 'Mina Sunil Pawar' however all these names are of the petitioner and she is one and the only person. Here it is to be noted that as per the pleadings in Paragraph No. 6, the petitioner had made application on 25.08.2023 whereas the affidavit has been filed on 22.02.2024. The application at Page 35 annexure E is in the name of Meeratai Sunil Pawar and we reiterate that the verification to the present petition is under name Meena Sunil Pawar.
4.
Another fact that is required to be noted is that the petitioner has not added Smt. Gavhane as party respondent and it is not stated that when she came to be appointed at another place. In her representation dated 28.02.2025, she says that the said post is vacant since last two years. There are doubts regarding the petitioners
representation also and, therefore, we are not inclined to exercise our powers under Article 226 of Constitution of India. 5.
Petition stands rejected.
