Learned counsel for the applicants submits that the parties have decided to settle the matter amicably. In order to effectively resolve the dispute, it is necessary to join respondent no.2 as a party respondent in the appeal filed so as to record the compromise.

Mr. Sonawane, learned counsel appears for respondent no.1 as well as respondent no.2 i.e. proposed respondent and submits that respondents have no objections to allow the application to the extent of respondent no.2 to join as a party respondent to the appeal. He undertakes to file Vakalatnama for respondent no.2.

In view of the submissions made that in order to facilitate the parties to resolve the dispute amicably and to record the settlement, the application is allowed in terms of prayer clause 'A'. Necessary amendment to be carried out within one week.
