ORDER:- 1.

Heard learned Counsel for the applicant - wife. The respondent - husband, though served with fnal disposal notice, remained absent.

The applicant - wife is seeking transfer of Marriage Petition bearing PA No. 1350/2021 fled by her husband in the Family Court at Pune for getting divorce, to the Court of Civil Judge (Senior Division), Kopargaon, District Ahmednagar. According to the applicant-wife, she is not having any independent source of income, and therefore, it is diffcult for her to travel from Kopagaron to Pune which is approximately 250 kms away. On the contrary, the respondent is having substantial income and he can very well attend the dates of aforesaid proceeding, if transferred to Kopargaon as he is

(2) 958 MCA-280.2021.odt already appearing the dates of proceedings initiated by applicant at Kopargaon under the provisions of Domestic Violence Act.

There is no oppose to the application by the respondent, who preferred to remain absent despite service. As such, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The Marriage Petition PA No. 1350/2021 pending in the Family Court No.5, Pune is transferred to the Court of Civil Judge (Senior Division), Kopargaon, District Ahemadnagar for disposal according to law.

(iii) The respondent is directed to appear before Civil Judge (Senior Division), Kopargaon on 14th November 2022.

(iv) The application is disposed of accordingly.
