Respondent No.2 filed a criminal complaint against the applicants alleging that they had committed offence under Sections 315 and 109 of Indian Penal Code r/w Section 3 of the Medical Termination of Pregnancy Act, 1971 2.

The applicant No.1 and respondent No.2 were husband and wife.

It appears that the complaint was made because of the matrimonial dispute. The

cria5728.15 parties have settled the dispute. They have now obtained the divorce decree by consent. The parties are before the Court. The respondent No.2 now tells us that he would not continue with the case.

In view of this the application is allowed in terms of prayer Clause (B) and disposed of.
