FINAL ORDER :

Considering the reply so filed by respondent No.2, and as the petitioner is absorbed on vacant post of Teacher, and as the petitioner has joined the vacant post, and as the Education Officer has sanctioned the absorption of petitioner, we are inclined to dispose of this petition as the impugned order was declaring the petitioner as surplus. However, there is a force in the contention so far as the aspect of seniority of petitioner is

Writ Petition No.10505.16 concerned, which, in our view, is required to be considered by the Education Officer in accordance with law. Therefore, liberty is granted to the petitioner to make representation within two weeks. The respondents to deal with the same as early as possible, preferably within six weeks thereafter in accordance with law.

Writ Petition is disposed of accordingly. No costs. 3.
