Perused the application. In view of reasons mentioned in the application, there is no impediment to allow the application in the interest of justice. Hence, civil application stands allowed in terms of prayer clause 'A', 'B' and 'C'. The order of dismissal passed by this Court dated 29-04-2009 is hereby set aside and quashed by condoning the delay caused in filing present civil application. 3.

The First Appeal No. 582 of 2008 with connected Civil Application is restored at it's original stage. 4.

The applicants are permitted to issue notice to unserved respondent No.1 on the address mentioned in paragraph No.5 of present application.

Accordingly, civil application stands allowed and disposed of in above terms.
