IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8395 OF 2017 WITH WRIT PETITION 3770 of 2017 SUNILKUMAR SHIVKUMAR APPASAB DESHMUKH

VERSUS

ARCHANA SUNILKUMAR BASWANTRAO DESHMUKH ...

Advocate for the Petitioner : Shri R. B. Deshmukh AGP for Respondent- State : Shri S. K. Tambe ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 24th JULY, 2018.

...

PER COURT :

1.

I have considered the submissions of the learned Advocate for the original appellant- petitioner at length. 2.

His contention is that the impugned order dated 02/09/2016 passed by the learned Appellate Court below Exhibit 13, in Regular Civil Appeal No. 55/2015 is not merely an order in one proceeding, but is an order passed in Regular Civil Appeal No. 56/2015, as well.

3.

I have considered his submissions. It appears that the petitioner is confused as to whether, the impugned orders are

2 915-WP-8395-17 with WP-3770-17 .odt delivered independently in Regular Civil Appeal Nos. 55 and 56/2015, or amounts to a single order, by which, he has to pay lump-sum interim maintenance amount of Rs. 25,000/- inclusive of court expenses to his wife.

4.

Both these petitions are filed out of confusion of the petitioner, who concedes that if the lump-sum amount of Rs. 25,000/-, is ordered to be paid, he has no grievance. 5.

In view of the above, both these petitions are disposed of with liberty to the petitioner to approach the learned Appellate Court and seek a clarification, if so advised. (RAVINDRA V. GHUGE, J.) shp/-
