The petition is by the parents of the petitioner challenging the order passed by the Family Court, Dhule. There were proceedings pending between the parties. Now, the parties have amicably settled all the disputes pending between them. In view of that, settlement deed is also prepared and divorce proceeding is filed by mutual consent. The husband had filed a proceeding for declaration of nullity of marriage and now the same is converted into the petition under Section 13(b).

In paragraph No. G of the said petition, a reference is made to the present petition and the parties have undertaken to withdraw this petition and also pursuant to same have withdrawn unconditionally the original proceeding i.e. Criminal Miscellaneous Application No.440/2019. The petitioners have also produced on record the order dated 13.01.2023 passed by the learned JMFC dismissing of the Criminal Miscellaneous Application as withdrawn. The case status also shows that the nature of dismissal "Uncontested - WITHDRAWN BEFORE EVIDENCE". Thus, in view of this, the learned Advocate for the petitioners prays for withdrawal of the Writ Petition. The liberty is granted by taking withdrawal pursis on record alongwith Exhibit 1-A to the said pursis. The same is marked as '

X' for identification.
