On the last of hearing, after hearing the learned Counsel for the Petitioner this Court has expressed the view that since the order passed by the Additional Secretary of State of Maharashtra is unreasoned order, the same cannot sustain.

Learned Counsel for contesting Respondent No.4 submits that appropriate order be passed.

Perusal of the order impugned indicates that same sans any reason. Any unreasoned order cannot be sustained. On this ground itself, the order impugned is set aside. The proceeding is relegated back to the Authority for decision afresh. Since the proceeding is of year 2008, 71 WP 6360.2010.odt
the Authority is directed to decide the same expeditiously and in any case within a period of six months from today 4.
