ORDER:- 1.

Heard learned Counsel for the applicant - wife. The respondent husband, though served with fnal disposal notice, remained absent.

The applicant - wife is seeking transfer of HMP No.70/2020 pending in the Court of 3rd Jt. Civil Judge (Senior Division), Osmanabad fled by respondent - husband for getting divorce, to the Family Court, Latur. According to the applicant-wife, she is residing at remote place from Latur and therefore, it is not convenient for her to travel at Latur and from there to Osmanabad. Moreover, despite the order of interim alimony in the aforesaid Hindu Marriage Petition, the respondent - husband has not deposited any amount. Further, the applicant wife is not having any independent source of income. As such, considering the convenience of

ORDER

(i) The application is hereby allowed.

(ii) HMP No.70 of 2020 pending in the the Court of 3rd Jt. Civil Judge (Senior Division), Osmanabad is transferred to the Family Court at Latur for disposal according to law. (iii) The respondent is directed to appear before the Family Court, Latur on 21st November 2022.

(iv) The application is disposed of accordingly.
