Datta Cnyanoba Wasmatkar v. The State Of Maharashtra And Others
{1} wp11914-18.odt
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 11914 OF 2018 Datta s/o Dnyanoba Wasmatkar Petitioner
Versus
The State of Maharashtra & others Respondents Mr. R.S. Deshmukh, advocate for petitioner.
Mr. S.B. Yawalkar, A.G.P. for Respondents no. 1 and 2. CORAM : R.M.BORDE & MANGESH S. PATIL, JJ.
DATE : 24th October, 2018 PER COURT:
The petitioner is objecting to the tender process initiated in pursuance to the issuance of tender notice on 04.08.2018. It is revealed that the tender process is complete and the work order has been issued by the employer on 15.09.2018. Duration of the tender work is of six months. In all probabilities, the successful bidder might have commenced the work and must have carried out the same in substantial quantity. At this belated stage of the proceedings, interference by this Court is likely to prejudice interest of the employer i.e. local authority.
In this view of the matter, in exercise of extraordinary jurisdiction under Article 226 of the Constitution, no interference is called for. Petition is devoid of substance. Writ Petition stands dismissed.
