It appears that two last chances are already granted to respondent, but the learned counsel for the respondent remained absent. Today also he is absent. As such, the matter is worked out in the absence of the respondent or his counsel as per the order dated 09/12/2022.

Heard learned counsel for the applicant.

The applicant is seeking transfer of HMP No.113 of 2021 fled by respondent husband for getting divorce, from the Court of CJSD Sangali to Family Court, Latur.

It appears that the applicant is not having any independent source of income and she has to maintain two children begotten out of this wedlock. Moreover, recently the applicant has fled EPetition in Family Court, Latur for getting maintenance from the respondent under Section 125 of Cr.P.C. Thus, it appears that since the respondent will have to attend the dates of the aforesaid E-

2 968 mca 294-21 Petition at Latur, proceeding fled by him at Sangali can be conveniently transferred as prayed by the applicant. Hence, following order.

ORDER

(i) The application is hereby allowed.

(ii) The HMP No.113 of 2021 pending in the court CJSD Sangali is transferred to Family Court, Latur for disposal according to law.

(iii) The respondent is directed to appear before the Family Court, Latur on or before 25/01/2023.
