IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 10436 OF 2016 Pragati Sainathrao Patodekar ...PETITIONER versus The Dean Government Ayurved College Nanded & ors.

...RESPONDENTS .....

Mr. S. M. Vibhute, Advocate for petitioner Mr. V. M. Kagne, AGP for respondents .....

CORAM : R.M. BORDE AND K.K. SONAWANE, JJ.

DATED : 10th OCTOBER, 2016.

Order :- 1.

The petitioner claims to be belonging to "Koli Mahadeo" scheduled tribe and is held eligible for admission of BAMS course as against seat reserved for ST category. The petitioner has been admitted to Government Ayurved College, Nanded. The petitioner claims that proposal for verification of tribe certificate is forwarded to the respondent No. 3 - Scrutiny Committee and the matter is pending for consideration with respondent No. 3 - Scrutiny Committee. It is also further stated that original tribe certificate received by her from the competent authority is also tendered with Scrutiny Committee. 2.

The petitioner makes a grievance that Dean of the Government Ayurved College, Nanded is not finalizing the admission on account of her failure to submit original tribe certificate and tribe validity certificate.

2 WP 10436-16 3.

In the circumstances, this petition can be disposed of by directing respondent No. 1 - College to admit the petitioner to BAMS course without insisting for original tribe certificate and tribe validity certificate. The petitioner, however, shall tender photo copy of tribe certificate received by her and shall tender undertaking to the effect that she would produce tribe validity certificate after decision of the Scrutiny Committee in respect of tribe certificate validation proposal. 4.

Respondent No. 3 - Scrutiny Committee is directed to take decision on the tribe certificate validation proposal of the petitioner, as expeditiously as possible, preferably within a period of one year from today.
