Heard the learned Counsel appearing for the applicant/appellant and the learned A.P.P. appearing for the respondent - State. Perused the findings recorded by the trial Court and the deposition of the witnesses, which are placed on record by the applicant/appellant.

In our opinion, the accused has not made out a case for his release on bail. We do not feel it appropriate to elaborate the reasons at this

2 11-crappln5711.odt stage since the appeal of the applicant is pending. The application for bail stands rejected. 3.

The appeal is admitted.

The learned A.P.P. waives notice for the respondent upon admission of the appeal.

Registry to send back the Record and Proceedings to the Sessions Court. Upon receipt of the Record and Proceedings, the Sessions Court to prepare the Paper Book and send it to this Court along with the Record and proceedings, as expeditiously as possible, however, within a period of three months from the date of receipt of the Record and Proceedings.

Liberty to mention for early hearing of the appeal upon receipt of the Paper Book.
