PER COURT :- 1) The Petitioner is praying for issuance of directions to the Respondents not to auction the sand spot of Godavari river near village Puntamba, Tq. Rahata, Dist. Ahmednagar, since the village panchayat has serious objections for auctioning of the said sand spot on ecological considerations.
2) Learned Government Pleader appearing for the State has presented an affidavit, wherein it has been stated that the decision has been taken to float e-tenders for excavation of sand in observance of the prescribed procedure. It is further stated in para no.12 of the affidavit that, the issue in respect of permission / sanction to excavate the sand is pending for consideration before the State Environment Impact Assessment Committee, and only after receipt of sanction from the said authority, permission letters would be issued to the successful bidder. IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD (2) WRIT PETITION NO. 10838 OF 2015 particularly clause no.17 provides for alternate mechanism for consideration of the grievances. It would be open for the Petitioner to approach the Sub Committee at the State level, in accordance with Clause 17 of the Government Resolution dated 26.05.2011.
If the Petitioner approaches to the Sub Committee at the State level within two weeks from today, the said Committee shall consider the grievances of the Petitioner and take appropriate decision within four weeks from the date of presentation of petition / representation by the Petitioner.
