Learned AGP submits that the petitioner has a remedy of appeal under Rule 17 of the Maharashtra Civil Services (Discipline and Appeals) Rules, 1979, as observed by the Tribunal.

In view of the fact that the petitioner has a remedy of appeal, we are not inclined to entertain the petition.

The Writ Petition stands disposed of. No costs.

The petitioner may file an appeal before the appellate authority, as observed by the Tribunal. If appeal is filed by the petitioner within four weeks from today, the same shall be considered on merits. 6.
Interim order passed by the Tribunal shall continue till the petitioner files appeal within four weeks.
