BENCH AT AURANGABAD WRIT PETITION NO. 10756 OF 2015 Shirin D/o Chandpasha Syed and another.. Petitioners

Versus

The State of Maharashtra and others .. Respondents Shri M. S. Syed, Advocate for Petitioners.

Shri V. H. Dighe, A.G.P. for Respondent Nos. 1 and 3. Shri Anup R. Nikam, Advocate for the Respondent No. 2. CORAM : S. V. GANGAPURWALA AND K. L. WADANE, JJ.

DATE : 26TH AUGUST, 2016.

PER COURT :

.

Mr. Syed, the learned counsel for petitioners submits that, petitioners had appeared for C.E.T. exam held for the Shikshan Sevak. The petitioners had obtained 123 and 114 marks respectively. The candidates who have obtained less marks than the petitioners have been selected and appointed and the petitioners have not been selected.

2.

Mr. Nikam, the learned counsel for the respondent No. 2 submits that, the petitioners had applied from open category and the cutoff merit of open category is 146 marks. As the petitioners' marks are below 146, the petitioners certainly could

2 wp 10756.15 not have been considered.

3.

The list has undergone change on many occasions. The respondent No. 2 has filed an affidavit that, cutoff marks for Shikshan Sevak from open category Marathi medium was 146 marks. The petitioners had applied from the open category Marathi medium.

4.

The grievance of petitioners is that, the respondent No. 2 has not filed the entire list of selected candidates as per merits. Mr. Nikam, the learned counsel states that, said list is published on the official website. The petitioners could have verified the same.

5.

In the light of that, the case of petitioners cannot be considered. As such, writ petition is disposed of. No cost. [ K. L. WADANE, J. ] [ S. V. GANGAPURWALA, J. ] bsb/August 16
