PER COURT :- 1.

This matter was heard for quite some time. After much deliberations and on instructions from the petitioner, the learned Advocate for the petitioner makes a statement as under:- A) Rs.10,00,000/- was the outstanding amount till 3.10.2019.

B) On 4.10.2019, the petitioner has deposited Rs.1,50,000/-.

C) The trial Court shall proceed with the bids programme.

D) The petitioner shall now deposit Rs.1,00,000/-. on/or before 30.10.2019.

BENCH AT AURANGABAD 2- WRIT PETITION NO.12107 OF 2019 E) He shall then deposit Rs.1,00,000/- on/or before 30.11.2019.

F) He shall deposit Rs.5,50,000/- on/or before 31.12.2019.

G) If any of the three installments are defaulted, the Court shall open the bids and dispose of the property and the petitioner would not raise a grievance.

H) Subject to the above, the executing Court which shall proceed with the bids on 5.10.2019 and 20.10.2019, shall keep the bids in a sealed envelope and shall not process them.

With the above time schedule and the conditions accepted by the petitioner and respondent No.1 / Bank, this petition stands disposed of.
