Mr. Panpatte, learned counsel for the petitioners submits that the report is submitted by the Deputy Director of Education to the State Government recommending that the order transferring the petitioner no. 2/school to the petitioner no. 1/institution should be cancelled. The petitioner no. 2/school is transferred to the petitioner no. 1 management in the year 2014 and since then the petitioner no. 1 is running the petitioner no. 2/school. All infrastructure and facilities are provided in the said school. The inspection was also made in September 2021 by the Block Education Officer.

Mr. Lakhotiya, learned A.G.P. accepts notice for respondent Nos. 1 to 4.

It appears that, there is no order passed by the authority cancelling the order transferring the petitioner no. 2/school to the petitioner no. 1/institution.

If at all the respondents/authorities want to take any further action pursuant to the report, then certainly the petitioners will be entitled for notice. The petitioners will have to be given an opportunity to file its say and then only the decision can be taken. 5.

As on the date, the order is not passed, nor the petitioners are issued with the show cause notice, the petition is premature. 6.
