PER COURT :- 1.

This is an application received through Jail wherein the applicant has prayed for extension of parole for 30 days. The Divisional Commissioner vide order dated 19.4.2015 had granted parole to the present applicant for 30 days. The applicant was directed to remain present with the prison on 20.5.2015. The applicant had filed an application on 4.5.2015 seeking extension of 30 days. It appears that no decision has been taken on the said application and the applicant on his own has returned to the prison after 60 days instead of 30 days.

We have heard learned APP also.

It appears that applicant was granted parole to attend his ailing wife. The application was given by the applicant to extend said period on account of the ailment of his wife, however, no decision has been taken on his application. Reason given appears to be genuine one. Considering the reason given for extension of parole, we find it appropriate to extend the said period of parole by

CRI WP 1366.2015.odt allowing this application. Said period of parole is extended by 30 days and said period is regularized.

Writ Petition is accordingly disposed of. No costs. 5.

In light of the above, show cause notice issued to the petitioner is also quashed and set aside.
