Applicant apprehends arrest in Crime No. 137 of 2023, registered with Daulatabad Police Station, Dist. Aurangabad, for offences punishable under Sections 306, 504, 506 read with 34 of the Indian Penal Code.

FIR is lodged by Manisha Nagnath Thakur alleging that her husband Nagnath Thakur was working as Head Store Corporate, in Dhananjay Auto Pvt. Ltd., MIDC, Waluj. Due to some financial difficulties, her husband taken hand loan of Rs. 1 Lakh from applicant and Rs. 50,000/- from Vijay Jadhav. He was paying interest of both loans regularly every month. Again their financial condition deteriorated and therefore her husband was Bhagyawant Punde

{2} 40-ABA-1585-2023 not in a position to pay interest to applicant and Vijay Jadhav. Therefore, both of them were threatening her husband. On 23.07.2023, her husband committed suicide by hanging himself. Informant claimed that due to harassment by applicant and Vijay Jadhav, her husband committed suicide.

Heard learned advocate for applicant and learned APP for respondent-State. Perused the investigation papers. 4.

From the investigation papers, prima facie, offence under section 306 is not made out. Offence is registered on 16.08.2023 and by now investigation is almost complete. Custodial detention of applicant, in the peculiar facts of the present case, is not warranted. The application is therefore allowed by confirming the interim protection order dated 26.09.2023.
