ORDER :

The application is filed by wife for transfer of divorce proceeding bearing HMP No. 444/2014 filed by the husband in the Family Court at Aurangabad. Both the sides are heard. 2.
It is the case of wife that she has kid of four years. It is her case that she has no resources and she will be required to spend on conveyance for coming to Aurangabad. It is her case that she may not be in a position to contest the matter filed by husband for divorce effectively, if the matter is kept in Aurangabad. It is her case that for her convenience, the matter needs to be transfer to the Court of Civil Judge, Senior Division, Jalna.

Other side has strongly opposed the application by
MCA No. 141/14 contending that one proceeding is pending in Badnapur Court for maintenance and in any case, she is required to come to Badnapur and from Badnapur she can come to Aurangabad. This submission is not acceptable. The convenience of the wife needs to be considered.

So, the application is allowed. HMP No.444/2014, presently pending in Family Court, Aurangabad is withdrawn from that Court and the same is transferred to the Court of Civil Judge, Senior Division, Jalna. Both the sides to appear in the new Court on 25.4.2016. The Trial Court is expected to expeditiously dispose of the matter within six months from the date of receipt of the record.
