Mr. Usmanpurkar, learned counsel appointed through High Court Legal Aid Services Sub Committee, Bench at Aurangabad to represent the petitioner.

Mr.Usmanpurkar, learned counsel states that the petitioner is challenging the order dated 20.03.2018 passed by the learned Ad-hoc Additional Sessions Judge, Parbhani therein since the application for condonation of delay to present the appeal against the order dated 31.10.2007 in Summary Criminal Case No. 1324/2006 came to be rejected. Initially, the petitioner has filed the private complaint bearing registration SCC No. 1324/2006 against the proposed accused persons therein, which came to be dismissed for want of prosecution vide order

926-crwp-1429-18 dated 31.10.2007. The said order itself was assailed in the year 2016 after the period of nine years by filing application for condonation of delay. The learned Sessions Judge while rejecting said application held that the petitioner has not explained the delay in proper manner, therefore rejected the application for condonation of delay. 3.

The perusal of the said order finds that it is based on adequate justification and requires no interference by this Court. Accordingly, this writ petition is dismissed. Hence disposed of. 4.

Learned counsel for the petitioner is appointed through High Court Legal Aid Services Sub Committee, Bench at Aurangabad and his fees be quantified and paid to him as per rules. ( SUSHIL M. GHODESWAR ) JUDGE shp/-
