Heard learned counsel for the applicant and learned APP for the State.

Considering the role attributed to the applicant and the evidence collected against him, there appears no direct evidence against the applicant. It has been alleged against him that he gave a contract to kill the brother of the injured as he was proposed to marry a girl to whom he was loving. After going through the material collected against the applicant, there seems no prima facie material to keep the applicant behind the bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Prashant @ Pappu Gopinath Kotkar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty

926-ba-1835-2022.odt (2) thousand) with one solvent surety in the like amount in connection with Crime No.369/2022, registered at Ahmednagar Camp Police Station, District Ahmednagar for the offence punishable under Sections 307, 120-B, 326 read with Section 34 of the Indian Penal Code and under Section 4/25 of the Arms Act, on the condition that he shall not involve in similar offence.
