The learned counsel for the petitioner, on instructions, seeks leave of this court to withdraw the present writ petition with liberty to file the civil suit claiming his right over the suit property, praying therein for restraining the defendants to access the land of the petitioner. 2.

In view of the above, the writ petition is dismissed with liberty as prayed for.

It is well settled that any order passed by the Mamlatdar is the subject to the order of the civil court. If such civil suit is filed, the trial court to decide the same in accordance with law without being influenced by the observations made by this court.
