Issue notice to the respondent. Mr. A.B.Kale, learned counsel has instructions to appear in the matter and waives service of notice for respondent.

With the consent of the parties, civil application taken up for hearing. There is delay of 114 days delay in filing the first appeal. Applicants refers to contents of application and state that in those circumstances delay has been explained satisfactorily. 3.

Though learned counsel for the respondent purports to resist, veracity of the contents of the application is not overcome by production of any credible material. In the circumstances, having regard to the decisions in the case of Collector, Land Acquisition,

Civil applications accordingly are allowed in terms of prayer clause (B) and are disposed of.
